Below is an interrogative submitted to the Maryland HOA. I sent this before I posted on the Forum... awaiting a reply, if indeed one is forthcoming. ========================================================= cspanjunkie• a day ago I belong to an HOA on the peninsula. As with most organized groups of human beings, our HOA director-group ( I am not a participant) appears to be comprised of 'factions'. Apparently, an individual director said or did something that the majority faction has determined to be at variance with our HOA rules or regulations. To wit, it was agreed, by the majority of the board, to instruct the HOA's attorney to "investigate" the individual director. We (the membership) do not know the specifics of the investigation, nor do we know the details of the charges against the individual director. Question: Is there a provision in Maryland law that permits four citizens, that just happen to serve on an HOA Board, to instruct their contract attorney to conduct a personal investigation of a fellow citizen and fellow Board member? |

For reference, the above message is a reply to a message where: Is this attorney's action actually protected under law? I mean, essentially, the situation as I see it is this: A few American citizens (who happen to be HOA board directors) appear to be using a member of the Bar to investigate a fellow American citizen. Beats me, but you raise a good question. What OPA document, or other Maryland corporate law, provides the board president authority to ask the OPA attorney to investigate anyone? Why don't you send an email to directors@oceanpines.org and ask. |
