OPA can issue a violation based on its own documents and regulations as contained in the ARC/ECC Guidelines which are, in turn, authorized by the DR's. The section on "Vehicle Storage" was included in my recent post # 884921. One of the factors included in the "junk" decision matrix is "absence of current state registration." | ||||||

For reference, the above message is a reply to a message where: Why not call the county? These vehicles are not covered. OPA speaking to an owner is not the same as sending the owner a violation notice. Keep in mind that the OPA DRs and county law are different. The DRs contain no reference to vehicles without registration, only junk vehicles. OPA could possibly issue a violation on the premise that the county law definition of a junk vehicle is: Any vehicle which is without a currently valid license plate or plates or any vessel which is without a valid certificate of number or valid use sticker and is in either a rusted, wrecked, discharged, dismantled, partly dismantled, inoperative or abandoned condition. A "junk vehicle or vessel" shall be classified as to its condition as either a restorable junk vehicle or vessel or a wreck junk vehicle or vessel: a restorable junk vehicle or vessel is one that is in a condition whereby repairs to the same could be made to place it in operating condition without exceeding the estimated value when repaired; a wreck junk vehicle or vessel is one that is in such condition that it is economically unsound to restore the same to operating condition considering the repairs to be made, age of the vehicle or vessel or market value of the vehicle or vessel if it were restored or in such condition that the public officer determines that it warrants such classification. Whether that would hold up in court is anyone's guess. Would be worth a try however. OPA should be trying every avenue available to get these unregistered cars out of here. In fact, the board should consider a DR change across all sections. My guess is it would pass. |
