Please direct me to the governing document that grants the authority to the CPI to "issues a violation".
Why do you persist in this nonsense? You can parse words and "governing documents" till the cows come home. It will not change the fact that violation notices are issued originally by CPI. If CPI cannot resolve them they go to ARC. If ARC cannot resolve them they go to the board. You may not like the process and you may not agree with the wording, and you did not vote for M-01 when you were on the board, but as I recall all six other board members did vote YES. In short, the board has the AUTHORITY and the board has DELEGATED its authority to issue violation notices to the CPI department. Unless or until some court says the process is illegal or OPA board changes it, it will remain the OPA process. To copy from M-01 a Board Resolution in full effect: c. The Compliance, Permitting, and Inspection Department (CPI). CPI shall be the point of contact for violations. CPI activities shall include but not be limited to the inspection of properties, receipt of and investigation of complaints, preparation and issuance of notices of violations to members, maintenance of records of complaints and violations, recommendations for the disposition of violations, and preparation of reports and records of violations. |
