Inaction by Boards can lead to lawsuits - case in point - the $20 million lawsuit awarded to a family because the HOA did not inspect their playground equipment and a child was severely injured. The HOA only had $2 million in coverage and there may be a special assessment to make up the remainder.

For reference, the above message is a reply to a message where: The Ocean Pines Board has proven they cannot be trusted if the only answer they could come up with was paying the government to kill our geese without any open discussions and then notifying residents after the fact using our money to do it. Sharon, We can all see that this is an emotional issue for you. You are ignoring what has been written on this form and in the local papers on what was done in the past to address the geese problem. It is the OPA Boards responsibility to protect its Members from potential liability issues and this includes health related issues. It’s not a stretch that someone could get sick from goose feces or slip and fall in their droppings. Inaction by Boards can lead to lawsuits - case in point - the $20 million lawsuit awarded to a family because the HOA did not inspect their playground equipment and a child was severely injured. The Board did the right and legal thing by having the geese removed - a precaution to protect the health of citizens. Tom |
