Section 5: OPA Board Subject: A Legal Conundrum? Msg# 1022232

Bunting volunteered as an expert on drainage and his participation in no way indicates any county responsibility or obligation for the county in regard to OPA drainage.
Bailey is 100% the person trying to place drainage maintenance on individual association members. At a prior committee meeting Bunting expressed doubt about Bailey’s interpretation of the DEs. As for Bainbridge, most all the ditches are in easements next to lotps or on lots. |

For reference, the above message is a reply to a message where: That sounds like a group to address the flooding near Bainbridge park, and the recurring swamping of surrounding streets. Wondering how this got diverted into the $$$ for individual trench maintenance. With Jim Bunting on the group, seems there's thought to be further County involvement. A mystery of how the issue you've addressed has even come up. Obviously the Bainbridge area problems encompass far larger stretches of trenching, instead of the individual trenches of individual owners. |
