Section 5: OPA Board Subject: A Legal Conundrum? Msg# 1022980

I did not say the GM is stupid (your words).
Trying to separate a description of what Bailey has said from from a view of his abilities is just spin on your part. He is the same lawyer who at this year's annual meeting improperly allowed a hand count on motions. Are you sure about that? I was not at the meeting, but watched parts live and reviewed other parts on line. The one motion I saw appeared to be in accordance with 3.05 of the Bylaws. After some initial confusion regarding the manner of count, it appeared to me that the count was by voting cards raised in hands. My recollection was that there was not a final count because the limitation to voting cards clearly established the result. I can wait for budget proceedings to play out on how to judge Bailey's agenda and the Board's response. I'm just commenting on what I see as unwarranted manner of criticism on the drainage effort. The sky is falling tale is hysteria based on incomplete facts. Your comments qualify. Jim Trummel |

For reference, the above message is a reply to a message where: Thank you. I will self-identify and maintain my position that Bailey's actions and statements on this issue are stupid. Please note, I did not say the GM is stupid (your words). Perhaps someone else did. I said his position and comments on this issue are stupid. As for the lawyer's comments, he is the same lawyer who improperly refused a request by Ted Aranow to make a motion at the annual meeting last year. He is the same lawyer who at this year's annual meeting improperly allowed a hand count on motions. I believe Bailey's total approach with this drainage issue and with the road cost number is noise to pave the way for increased reserves, increased equipment, and increased employees. One thing Bailey and the board should be doing is looking into outsourcing our roads landscaping, grass cutting, and drainage work. As for the sky falling, certainly not. Stupid actions by OPA are nothing unusual. |
