The quote below from the article confirms that OPA filed improperly as the application was filed without board approval. Parks, making matters worse and possibly a felony, subsequently sent a false statement to the bank saying the board had approved the application. In addition to the above-listed documentation, in order to obtain a PPP Loan, an applicant must make a good faith certification (i) that current economic conditions make the loan necessary to support ongoing obligations, (ii) acknowledging that funds will be used to retain workers and maintain payroll or to make mortgage, lease or utility payments, and (iii) that the applicant does not have an existing application pending with the SBA for (or has not received) a loan for the same purpose. The certification should be approved by the Board of Directors of your association and signed by an officer or Board member. Your association should consult with legal counsel for purposes of preparing the required certification and necessary approvals. |
