Perhaps, but we don't know whether she spoke with her own attorney or not. And you are absolutely correct in regards to legal costs. However, you can fight City Hall when you are correct and don't mind spending some money. I sued the State of Maryland with regard to declaring the American shad an endangered species and won. I and another fellow sued the then Worcester County Sanitary Commission. They settled without going to court and nearly $1 million was returned to OPA ratepayers. All that said, you have done no more than state the obvious. As I wrote previously, the most troubling thing about this episode is that the board did not allow Colby to present her charges to them directly or bring witnesses on her behalf. On the flip side, the accused was not able to confront his accuser and present witnesses on his behalf. As for Nate, he did go to court against OPA and LOST. Slobodan never went to court on the attempt to remove him. |

For reference, the above message is a reply to a message where: Joe: there in lies the problem. The BOD uses our dues to hire an attorney, effectively to defend Perone. Colby could have used her own money to hire a lawyer to represent her and to give her LEGAL guidance. Perhaps that lawyer would have said not to file under B-08. You are always telling people to go to court if you feel you have been wronged by the BOD. If the BOD paid $15k for a lawyer, you can bet it would have cost Colby more for her defense. Then just like with Nate and Slobodans cases the BOD would have gone to court (more of our dues). I don’t know how much N&S spent on their defenses, but as they say “you can’t fight city hall”; especially when “city hall” has unlimited funds. |
