The issue of the applicability of 1st amendment and federal law has already been decided in numerous instances of case law. This quote from one of those decisions: "Well, one may ask, what about our First Amendment right to free speech? HOAs and condo associations are private communities, not the government or a state actor, and thus the First Amendment does not apply." | ||||||

For reference, the above message is a reply to a message where: Are there really people out there who think HOAs can ignore federal law? You did not reply to the issue of first amendment rights applying to government prohibitions as opposed to a private entity like an HOA and whether or not you believe an HOA in Maryland may regulate signs via the HOA Act in a more restrictive manner than possibly a county government. The issue at hand is not county sign rules |
