So… the signs could remain for months, making the Guideline useless as a practical matter if the violators refuse to comply?
If so this is exactly what I predicted when the Guideline was passed. |

For reference, the above message is a reply to a message where: ARC Guidelines 600.6A limits sign removal by OPA to non-compliant signs on common elements. A violation of the Guidelines is within the provisions of Resolution M-01. However, step 4 of M-01 states that the Second Notice will inform the Responsible Party (responsible for violation) that judicial action may be initiated as well as the resolution actions that lead to sanctions. My guess is that as long as the signs are in place, the Association will not use the step 4 judicial action option. Instead the remaining steps will continue until a resolution which could in include both sanctions and judicial action (step 5) Jim Trummel |
