A violation of the Guidelines is within the provisions of Resolution M-01. However, step 4 of M-01 states that the Second Notice will inform the Responsible Party (responsible for violation) that judicial action may be initiated as well as the resolution actions that lead to sanctions. 

My guess is that as long as the signs are in place, the Association will not use the step 4 judicial action option. Instead the remaining steps will continue until a resolution which could in include both sanctions and judicial action (step 5)
