According to your text M-01 states “determining if a Violation exists, which may include entering lots to conduct visual inspections and documentation of subject properties,”. Would you please direct me to where the authority comes from that would allow “include entering lots”? Thanks. Marty |

For reference, the above message is a reply to a message where: Who initiates a complaint sent to homeowner? From Resolution M-01: 4. Definitions. B. Complainant: An individual or entity that brings a potential violation of the DRs or ARC Guidelines to the attention of the CPI. 5. Responsibilities. C. CPI: CPI shall be the point of contact for Violations and shall be the investigating department in regard to Violations, subject to GM oversight. CPI activities shall include, but not be limited to, receipt and investigation of Complaints, determining if a Violation exists, which may include entering lots to conduct visual inspections and documentation of subject properties, preparation and issuance of notices of Violations to lot owner and any other Responsible Party, maintenance of records of Complaints and Violations, making recommendations for the disposition of Violations, and preparation of reports and records of Violations. ARC responsibly is also in M-01, however it is limited to review of a request for exception/variance that may come from the Responsible Party during the violation process. M-01 is not an easy read. However, one is not going to have an understanding of the violation process without reading the resolution,. (maybe more than once) Jim Trummel |
