For reference, the above message is a reply to a message where: I think we are spending too much time focusing on M-01. Our DRs only allow OPA to “enter upon said lot” at Article 15 and only with a 2/3 vote by the board to conduct maintenance. I know of no other legal authority for OPA to trespass on a private property shy of an order from the court. Bruce Bright apparently does not agree with your interpretation and wrote: "Pretty sure this discussion is a re-run of a prior one. . . "That said, CPI will never enter property without first seeking permission from the owner, they will exhaust all other means of observation (viewing from neighboring properties or the street), respect privacy, and they will exercise caution and always avoid surprise and/or confrontation." Given Bright's success in court over HOA issues related to OPA, why would you not want to accept his interpretation - absent any contradicting case law. |
