The property at 32 Battersea Road was a part of Mr. Terry's motion and the board did indeed vote to find that property owner in continuing violation and send them to legal in order to obtain an injunction in order to remove the vehicles in question. The subject property owner's right to due process will not be infringed and they will have an opportunity in court. Marty |

For reference, the above message is a reply to a message where: My understanding is that Moore is going directly to court to file a complaint to have the vehicles removed, Marty at the last session told me they were NOT going back to the ECC/ARC for any further concurrence. Oh? I know of no board vote to by-pass all due process for the association member's property in question. Should that happen, I wonder if Moore will inform the court that his request for relief is coming without the due process afforded all other association members and as laid out in a formal Board Resolution. The "soap opera" continues but maybe headed in the right direction. If OPA eliminates due process for this lot owner then it sure is not in the right direction. |
