Section 5: OPA Board Subject: Motion to Remove Director Trendic Msg# 987816

Now employee gripes are to be expressed to the law firm hired by and reporting to the GM.
----------------- ""Gripes" are not reported to the attorney handling OPA corporate legal matters. They are reported to a different person in a separate HR division of the firm." ----------------- Precisely; the same law firm that handles HOA matters and I presume that means litigation. So if an OPA employee has a legitimate issue which would involve litigation are you telling me the firm would handle a suit against themselves? I believe under most circumstances, the law firm has two options: (1) get both parties to waive the conflict of interest, or (2) withdraw from representing either party to the case. Depending on the circumstances, the firm probably cannot represent either party in such a case. ----------------- "Regardless, could you explain to me how OPA HR operations are going to be handled without any GM involvement. There was money budgeted to hire a HR employee for years. Such an employee would be hired by, and report to, the GM." ------------------ I don’t think it would be that difficult or complex. Have the HR person report administratively to the GM but directly to the board member designated concerning employee complaints regarding the GM. This presumes the board president is capable and willing to confront the GM. The issue is not to whom they report the issue is they don’t exist. One function of the person would be to advise the GM not to do stupid stuff regarding employees. They would be a resource not an adversary. ------------- "Do you own property in Ocean Pines?" ------------- Not currently. If owning property in OP is a condition for posting on your opinion forum you should so state. Given the direction of OP governance I’m rather happy I don’t currently own property there. I have ties (friends) in the community and think the community deserves better. They appear to have more to hide than Trendic. How is that for a theory? ------------- "Just more innuendo with zero supporting facts. Sounds like a political statement." The operative word is “appear”. I didn’t state it was a fact – I plainly stated it was “theory”. Perhaps you prefer the term “optics”. Sight is one sense, smell is another. Both are bad in this case. Are not most posts on this forum political including your own? |
