Considering there's been 49 or 50 plus yrs in OP without this kind of GM intervention, it appears totally unnecessary. And such lien searches are routinely done by trained assistants, not the head guy. And should be clearing & processed very promptly. Sounded like Marlene Ott was held up for some time with situation being unresolved. (granted I'm not sure exactly how long it was)
Nothing is more unsettling than when there's some rescheduling of closing dates, when $$$$ thousands will be changing hands. Although there's complexities of settlements, especially in the minds of laymen, it becomes rather routine for realtors, lenders, & settlement officers. Education seminars are fine. But so is advance notice. Along with transparency. Seems that one or both steps were omitted. Maybe a pattern we've heard about before(?) In the case of out of state transactions/realtors, etc. how would OP even monitor transactions violating this policy?? Seems that OP would only find out violations some periods of time after the fact. Even if periodically inspecting the county land records were to occur, then the transactions would already be closed. And OP would be chasing violators, after the fact, for unpaid assessments Tom

For reference, the above message is a reply to a message where: And now the real estate sales snafu-- his OK needed before folks can sell their homes?? A self-inflicted injury. No excuses will suffice for that practice. Not really a real estate snafu, Tom. There is a legal process in which an HOA must physically inspect the home to ensure physical changes to the property were approved and that there are no pending property liens. Besides that, due to internet sales, we have out of state realtors and closing companies that are unaware of MD laws or HOA covenants. Settlements have been completed without HOAs being paid back assessments. We had this situation come up in the Parke and the time and energy to correct the problem is time consuming. JB told me that when he was in Virginia, his association held real estate seminars to educate agents and settlement companies and he plans to do the same here. Meanwhile, I assume he is personally reviewing settlement documents to get a lay of the land. Tom |
