Indeed, that's the missing link --no will power, and lack of decision-making.
The heart of the problem. I have never heard the board hold a serious discussion about enforcing the DRs. For Example spending $195 locally filing a case for junk vehicle removal VS estimates of $5,000 to $50,000. Way over the top. The $195 was the cost to file paperwork. The possible $50,000 is a wild guess at extended legal actions possibly going to the Maryland court of appeals -- I would assume/hope. Regardless, according to my source, no owner has ever even contested a junk car removal so legal fees have been minimal, absolutely minimal, in regard to court orders for removal. |

For reference, the above message is a reply to a message where: Wow. An outstanding commentary. You've systematically taken apart the arguments by director Daly. Step by step. Pointing out how OP's "total failure of leadership at both the management and board level" have gotten OP where we are at -- i.e. 26 cases of flagrant violation cases, some quite old, with the worst being about 11 yrs of continuing problems -- still unresolved. You've also pointed out how those proposed DR provisions are likely to fail. -- With these cases of financial distress, mortgages underwater, etc, assets would rarely be available, -- no bucks $$$ or equity allowing recovery of attorney fees, or accumulated fines, In addition you've shown how the existing provisions will work, when and if those steps are taken in timely fashion. Indeed, that's the missing link --no will power, and lack of decision-making. Also, I'd totally agree its time to change attorneys-- away from that western shore, DC centered law firm. As you've said: With even a modicum of research, Daly would have found the quotes he claims came from OPA's new attorney over near Washington, D.C. for obtaining a court order are ridiculous compared to past costs when OPA had local counsel.
