John, As far as I know the lawyer investigated a claim made under board resolution B-08. I believe the attorney actually asked Colby if she wanted her charges to be B-08 charges and she said yes. Thus the investigation involved only B-08 and not other possible federal law violations. The board, based on the B-08 investigation decided there was no B-08 violation. All this other stuff is just speculation with no factual support at this point. | ||||||

For reference, the above message is a reply to a message where: Jackie was very clear. The attorney found that the allegation of a hostile work environment was not substantiated and thus not illegal. I believe what Colby was actually alleging was a toxic work environment, which is not illegal per se but troublesome. Hostile work environment under Title Vii must be attached to a protected class such as her gender in order to state a claim, which I don’t think she was alleging. An employer can still act inappropriately and it is still legal. That’s exactly what Jackie said. The Board could still have taken some action even though the behavior was not illegal. Jackie is anything but radical. |
