I was aware of the Friday/Monday thing. I verified the material went in the mail on Monday. To the best of my knowledge, there was no big deal if someone on Friday or Saturday or Sunday had said, “Let’s hold the drop to post office for a day to see if Ringsdorf is correct.”
Maybe they checked and some lawyer told them you didn’t know what you are talking about. If so, they should have given you the legal opinion I had emailed the board well before you asking about the “phased” approach to bypass a referendum. No response either. They obviously have no intention of answering you or me , or so it would seem. Not to mention they apparently did not even respond to Trendic. I suggested Trendic call his lawyer. I don’t know if he did. Marty claimed this would cost $2000. Another ad with the same bulkhead wording appeared in the Gazette again yesterday and I expect will run again. |

For reference, the above message is a reply to a message where: Joe However, another shoe dropped recently, perhaps even more damaging to the board's reputation over its misinformation about bulkheads. Retired CPA and highly respected former OPA Assistant Treasurer Gene Ringsdorf wrote that OPA cannot hold a referendum on capital spending for private bulkheads because OPA does not own private bulkheads and, as a result, has never capitalized those bulkheads. He notified the board of this before the ballots were mailed. My email to the OPA board informing them that bulkhead expenditures are not capitalized and thus not subject to the referendum spending limits was sent on FRIDAY 4/9/2021 at 2:03 p.m. On the OPA website under the "NEWS" tab, an item stating that referendum ballots were mailed out to the membership this week is dated MONDAY 4/12/2021. Given the closeness of these two events, I am not sure the board had enough time to verify my email facts, adjust the message on their ballot inserts or stop the mailings. I have no idea what lead times are involved with having ads placed in newspapers this week so I do not know if the board had time to react to them either. In spite of the above, it is now past 9:30 p.m. on FRIDAY 4/16/2021, and I (and presumably no one else) have NOT gotten any feedback from any board member. At best, I find this very disturbing given the potential negative impacts on the referendum results and the perceived competency/integrity of this board should their silence on this matter continue much longer.
