a person owned a building that houses a bar. Now that person leases that building to someone to operate a bar. How does the building owner have any authority to ban anyone from the bar? |

For reference, the above message is a reply to a message where: Joe, we are not miles apart. My problem is that there is nothing in our governing documents that entitle the HOA board of directors to perform any law enforcement duties. No law enforcement required. If the same thing happens again, the offender should be banned, no matter who it is. Where did you get the idea that private businesses cannot ban troublemakers? The ban/prohibition just cannot be based on any of the classes protected by federal laws. Unruly customers are banned from bars all the time, commonplace. I expect police only become involved if a banned person refuses to leave. |
