Joe, since we are not a "closed club" and all our amenities are open to the public, I don't think that there should be a different set of rules for association members and public guests at any of our amenities. I realize that the judge seems to be discussing association members only in his ruling. I'm not an attorney and maybe that is only who our governing documents address.
From a practical and fairness standpoint I think some association wide guideline needs to be instituted whoever is causing a disturbance at one of our amenities, whether association member or not. John |

For reference, the above message is a reply to a message where: It is difficult for a civilian to determine, but it appears as it currently stands any association member in good standing can do what Janasek did as described in the eyewitness report and management cannot force the offender to even leave the premises unless perhaps there is some legal issue where the person can be removed by the police. Banning any association member in good standing for any period of time for actions as described in the eyewitness report is currently impossible it would seem. |
