Joe - At issue in the case is not whether Bar/Restaurant management can deal with disturbances at the time they occur, even involving OPA members. That's been happening forever and will always happen. In fact, Bar management dealt with this particular disturbance at the time it occurred. And there's no claim being asserted by Tom on that basis. The lawsuit is about what the BOARD majority did afterward, for the first time ever -- convening a special meeting and banning Tom for 90 days. The case just isn't about what you seem to want to make it about. As far as whether the Board or the GM could take action in the future as to, for example, some repeat offender/problem OPA member (Tom isn't in that category), I think there are ways for that to occur properly, but it's not my job to map that out. | ||||||

For reference, the above message is a reply to a message where: It is difficult for a civilian to determine, but it appears as it currently stands any association member in good standing can do what Janasek did as described in the eyewitness report and management cannot force the offender to even leave the premises unless perhaps there is some legal issue where the person can be removed by the police. Banning any association member in good standing for any period of time for actions as described in the eyewitness report is currently impossible it would seem. |
