I'm sorry. I thought you introduced the attorney/client problem a couple of postings back. Unless a board member is referencing advice given or strategy revealed by their attorney in a case, I see no attorney/client privilege problem. But then I'm not an attorney.
Then again, I was deposed in a case where most of the information I had received was from the attorneys working the case before I was named the litigation trustee. A five day tightrope that taught me firsthand the intricacies of the privilege argument. What you may be referring to is the good practice of having board members not discuss a pending case so that their words might be used against them or the board. |

For reference, the above message is a reply to a message where: I was responding to Mr.. Clarke regarding attorney client privilege. Directors should not be commenting on an open case. Mr. Farr apparently did and is quoted in the Progress. Mr. Janasek brought that up in his public comments Saturday. |
