For reference, the above message is a reply to a message where: I'm sorry. I thought you introduced the attorney/client problem a couple of postings back. Unless a board member is referencing advice given or strategy revealed by their attorney in a case, I see no attorney/client privilege problem. But then I'm not an attorney. 
Then again, I was deposed in a case where most of the information I had received was from the attorneys working the case before I was named the litigation trustee. A five day tightrope that taught me firsthand the intricacies of the privilege argument. What you may be referring to is the good practice of having board members not discuss a pending case so that their words might be used against them or the board. |
