For reference, the above message is a reply to a message where: Marty is correct. The problem with "adult only" swim times or areas is that they violate fair housing law which prohibits discrimination, based on "familial status" and other protected class categories, in regard to housing-related services and benefits. When children are excluded, this amounts to discriminatory treatment of families with children, and therefore discrimination based on "familial status." The issue has nothing to do with income tax status. As to the AC's revised proposal for evening poolside cocktails, and extending pool operation hours for that purpose, the Board has declined to proceed with that proposal for the following reasons: 1) to have these events or not have them is more of an operational matter than a Board policy matter; 2) OPA management wants to avoid the added expense and operational demands (including mobilizing staff and resources for the events); 3) this Board prefers to defer to management on this type of decision; and 4) there is also a concern to some extent about liability issues arising from poolside and swimming-related alcohol consumption occurring in the evenings.
