Exactly. Ortt cannot offer us positive cash flow between now and the end of April. Their saying they will fulfill their obligation only benefits Orrt and costs OPA. It's better for us to allow TOI the time to prepare the YC for the season now, rather than to wait 3+ months. Thanks to TOI for accepting a lease agreement in which they accept some of the risk and responsibility for their performance in running our F&B operations. Ortt had a guarantee of profit with no loss. |

For reference, the above message is a reply to a message where: It sounds to me that TOI made the pledge to step in when the old contract expires. Ortt has a contract to continue doing what they do until it expires. "Sounds" to you? More likely TOI would love to get in sooner. They have plans to do some redecorating work on the first floor of the Yacht Club. Those plans may have to be put off until after the season if Ortt stays until the end of April. As for Ortt's contract, it contains a provision whereby OPA can end it. There is nothing wrong with using a contract provision agreed to by both parties. It is not in OPA's best interests for Ortt to run all OPA food and beverage operations until the end of April. |
