Frank, everything you say is correct (at least down to the question, "How?"). But, it is not a simple problem and viewed from standpoint of the owners bordering the access points is a real headache.
Using the example of your property, how would you feel if OPA somehow converted the five foot utility easement down the side of your house to a pedestrian access easement for the golf course? (And multiple vehicles were parked on the street all day.) It's still your property, you have to mow it, but you can't fence it or plant anything on it. That is what the four access points between homes are. They are access easements not OPA owned property. The one access point at the head of the park which is used by the maintenance vehicles is OPA owned. If it were a simple problem, it might already be corrected. Your first two suggestions would require changes to multiple governing documents. Won't happen. Third is happening courtesy of Nancy Weber. (Though not likely metal and concrete) Fourth is a good idea. And lastly, police have no jurisdiction over this issue other than perhaps theft of signs. Bill Z |

For reference, the above message is a reply to a message where: I think its obvious that the property owners whose property abut the park land in question which is owned by and maintained by OP maintenance crews paid for by all OP property owners feel that this property is their own private preserve. You can say what you want but plain old common sense tells us this is the situation. If OP management is unable to rectify the situation so that the remaining property owners (with property not adjacent to the park) aren't being excluded from the park and simultaneously expected to maintain the park the property owners on the park should be held accountable. If other property owners whose property abuts park land pulled a stunt like this, OP would be in utter kayos. My lot borders golf course, suppose property owners with property bordering golf course began treating golf course as their own, taking down signs and obscuring access to golf course etc. How? Assess double assessments on properties bordering park. Require them to purchase park at assessed value. Clearly mark 5 access locations with metal signs and poles welded together and anchored in concrete. Have CPI regularly inspect to make sure signs are not tampered with. Here is a good suggestion, have OP police patrol the park !!! You don't fully appreciate suggestions above good, make some better suggestions. |
