Now, that said, let's talk about the OPA amenities other than the Beach Parking which I would argue is an anomaly.
Not really. The 4/30/2015 audited report shows that the Beach Club made a net profit of $61,114 ; Pickleball shows a net profit of $9210; marina shows a net profit of $87,543. These are bottom line net profits after adding depreciation as an expense. Beach parking was an anomaly only due to the size of the net profit - $412,846. I've been doing a lot of reading since this issue came up, and unless someone can convince me otherwise, I'm convinced that out status as a tax exempt organization is essentially contingent on all our facilities and amenities and our roads being open to the public, and further than if some facility is not open to the public and makes a profit then we must pay taxes on that property. I'm sure there are nuances but that's how I see it at the moment. |

For reference, the above message is a reply to a message where: Jim: I hope you don't think I was insinuating that you are not competent? Not true. I have the highest respect for you and your opinion. Now, that said, let's talk about the OPA amenities other than the Beach Parking which I would argue is an anomaly. I do not believe for even one second that anyone, IRS or otherwise, expects the property owners/OPA members, to invest in maintaining and improving amenities, which for the most part are located inside of what was not all that long ago a private and gated community, for public use by others.
