What is this first-time incident you claim Trendic "challenged, criticized, or directed an OPA employee?"
Joe - I didn't claim anything, its a matter of official record. Here is an excerpt from the minutes of the June 23, 2017, OPA Board meeting: President’s Remarks – Tom Herrick- Mr. Herrick stated “it is unfortunate, but I feel the need to address yet another misrepresentation of fact by one of our local newspapers in an opinion column. I would like to add truth and clarity to the circumstances regarding this issue for the benefit of our membership, as it affects the majority of your Board of Directors. One of the reasons for the closed meeting this past week was to discuss management concerns and Board member contact with staff. Our attorney was contacted to discuss the content of these conversations that were conducted with a number of our staff members and he advised it to be right and proper for our Board to discuss this matter in closed session. The circumstances were not as reported in the local newspaper and classified as being "obvious" to the writer that an employee by-passed their immediate supervisor, Brett Hill, and expressed concerns to one of our Directors, but, in fact, the complete opposite. A Director repeatedly was by-passing the acting GM and went directly to individual staff members causing alarm to a number of our employees. These were not "routine inquiries" that are permitted by our By-Laws. Some members of the Board understood the need to not allow this type of activity to continue, and in order to protect our association employees from this type of behavior in the future, brought the discussion to the entire Board of Directors for review. I hope this clears up any previous misconception of what had actually transpired.” The Director who by-passed the Acting GM and went directly to individual staff members was Slobodan Trendic. |

For reference, the above message is a reply to a message where: Regardless of the chain of events or language in the Ethics Policy, Slobodan violated OPA By-laws: Section 9.03. Board and Association Staff Relationships. Individual members of the Board of Directors shall not give orders to any employee of the Association and, except for routine administrative services and inquiries, shall deal with employees through the General Manager. The above is pure speculation on your part unless you know for a FACT that Trendic gave orders to any employee. Slobodan is an uncompensated and volunteer elected official. He has no right to privacy. And, for the uninformed, this is at least the second time that he, as a sitting Director, has challenged, critizied or directed an OPA employee - a violation of the by-laws. The last time the Board let him off the hook with a warning. Whether this is a minor or major incident is irrelevant. There was an incident, it is in writing and the Board is compelled by the By-laws and Ethics Policy to take action. I like the transparency, which is not in violation the MD HOA Act. No right to privacy? None? Surely you jest. What is this first-time incident you claim Trendic "challenged, criticized, or directed an OPA employee?" The board is not compelled to do anything. No one suggested the HOA Act is violated by naming Trendic. What is suggested is that naming Trendic was politically motivated by those out to get him thrown off the board. It sure sounds like you support that idea. Trendic is no angel, but he does not deserve the public lynching you appear to support. Interestingly, you have not provided a single FACT to indicate Trendic has violated any Bylaw or Code of Ethics. This is the worst sort of character assignation via innuendo. On the other hand, Colette Horn, by naming Trendic, has, in my opinion, violated the Code of Ethics she created. |
