Seems that the misconception of guilty until proven innocent, is alive and well in OP this morning. I'd suggest the opposite -- long live the presumption of innocence. Seems a poor choice of words to be writing here, against that presumption. It isn't helpful to add the words like regardless of the chain of events Again judgemental, prejudicial, guilty in your opinion regardless of . . . - EVEN before facts are known revealed, & weighed. For reference, the above message is a reply to a message where: This issue may have involved some interaction between Director Trendic and some public works folks working on drainage in his area of Ocean Pines. Is this a minor incident being blown out of proportion in yet another effort to remove Trendic? Regardless of the chain of events or language in the Ethics Policy, Slobodan violated OPA By-laws: Section 9.03. Board and Association Staff Relationships. Individual members of the Board of Directors shall not give orders to any employee of the Association and, except for routine administrative services and inquiries, shall deal with employees through the General Manager. Perhaps the upcoming review of the OPA Organizational Chart is being done to reinforce the above. Slobodan is an uncompensated and volunteer elected official. He has no right to privacy. And, for the uninformed, this is at least the second time that he, as a sitting Director, has challenged, critizied or directed an OPA employee - a violation of the by-laws. The last time the Board let him off the hook with a warning. Whether this is a minor or major incident is irrelevant. There was an incident, it is in writing and the Board is compelled by the By-laws and Ethics Policy to take action. I like the transparency, which is not in violation the MD HOA Act. I was an HOA President and dealing with issues such as this one is not easy. My advice to to others: If you can't take the HEAT, don't run for the SEAT! Tom |
