Section 5: OPA Board Subject: Association Member Sues OPA Msg# 1061066

The board and more specifically the board president has taken numerous actions that are outside the bylaws and resolutions and outside the authority of the board. Each time the bylaws as the governance documents of this association are ignored weakens the enforcement of any provisions of the bylaws. This lawsuit is about governance...my feeling is that this action is necessary to protect all members of the association from rogue board members and open defiance of the governing bylaws of the association. The board is spending our money on defending their illegitimate actions. | ||||||

For reference, the above message is a reply to a message where: Trendic resigned from the Board rather than to work within the system to provide a voice for his positions, as well as those in the Community that may share his views. He then deems his position so superior to those of individuals who have been elected by the Community that he takes a litigation route to address an issue that is not of current concern (what are the relevant +$1 million projects that are urgently awaiting action). Trendic could have stayed on the Board, and others that shared his views could run for the Board. Trendic decided to take unnecessary legal action, and now he wants his neighbors to pay his legal fees. |
