| Ed - I don't believe this can be mediated. There is no gray area, thus no room for compromise. It is a Black & White question. Either Farr is eligible or he is not. Hopefully the judge will rule definitively on this, which in my opinion is the only real issue. Only with such a ruling (either way) can this thing come to closure. | ||||||

For reference, the above message is a reply to a message where: I've said from the start that this question is ripe for mediation. As a mediator, I'd love a crack at it except I'm a wee bit conflicted. You've laid out the plaintiff's positions quite nicely. The defendant would come back with the DR's, the land records and advice of trust counsel as being binding on the association. |
