As mentioned by others, there are also some conflicts of Bylaws vs DR's Vs Charter, requiring some further clarifications as a future, necessary step. -- Regardless which way the court decision comes down.  And would seem foolish to be placing any bets on the court case.

I'd suggest that the inclusiveness approach is better in the long run.  Its been hard enough to get candidates to volunteer.  And the restrictive approach is divisive -- always leaving unanswered questions like -- What are "they" afraid of ??  Whose political backs are "they" protecting ??

Let the voters decide !!
