The only thing I might be trivializing is your ability to play surveyor. Yes there is a minor encroachment that harms nobody.
I am not playing surveyor. Why are you trivializing someone building structures on OPA property without permission? There is a survey that depicts said encroachment. No harm, no foul. OK. Not sure what you mean. One interpretation of your words is it is ok to build what you want on OPA property so long as it is surveyed afterward - "no harm, no foul." Joe, what do you think OPA should do about the encroachment? Not much OPA can do at this point perhaps. Unless additional construction took place in the encroached area and was not allowed under the lease agreement. Also, it certainly could be used as a major negotiation item in setting the lease amount. What would it cost Seacrets to have to remove all structures on the OPA property if OPA, as you suggest, requests they be removed? Looks to be a major part of their near beach operations. Does OC have any building setback requirements in that area? I became involved in this due to Nate Douty asking a question about the property line. I am still surprised that you seem to actually defend someone building on OPA property without permission. Your defensiveness on this is remarkable. |

That encroachment has been reduced to paper to protect OPA and Mr. Moore is responsible for removal of the encroachment and restoration of the land upon our request.
