Joe, we are not miles apart. My problem is that there is nothing in our governing documents that entitle the HOA board of directors to perform any law enforcement duties.
No law enforcement required. If the same thing happens again, the offender should be banned, no matter who it is. Where did you get the idea that private businesses cannot ban troublemakers? The ban/prohibition just cannot be based on any of the classes protected by federal laws. Unruly customers are banned from bars all the time, commonplace. I expect police only become involved if a banned person refuses to leave. |

For reference, the above message is a reply to a message where: Joe, we are not miles apart. My problem is that there is nothing in our governing documents that entitle the HOA board of directors to perform any law enforcement duties. We can’t make up rules as we go. i don’t condone verbal abuse but if something like this happens again and neither of the two parties are associated with the HOA, will you or anyone else be seeking a ban on amenities? What if they aren’t residents. Are we going to maintain a little black book containing a copy of everyone’s ID that ever had too much to drink and got into an argument with someone else? |
