More text from lease: Provided that the Lessee is in good standing under this Lease, the Lessee shall have a right of first refusal to purchase the real property described on Exhibit "A" attached hereto ("Property") on the same terms and conditions of any bona fide offer received by the Lessor. Seacrets gets the right of first refusal; total cost in first year of less than they were prepared to pay in prior lease; right to retrain their seating tables, bathrooms, storage, sound wall, etc., all built on OPA property without permission. For all these additional pluses for Seacrets, OPA receives $40,000 for the lease when our own consultant last August said $30,000 in old lease was under market value. Even in the last year of the five-year lease the total cost to Seacrets (lease and taxes) will be under $64,000, less than they were prepared to pay in the prior lease. This has to be one of the most one-sided negotiations in OPA history, and OPA has had some doozies. The papers say Bob Thompson negotiated this lease for OPA. Sad, very sad. Even sadder, the rest of the board signed on to this debacle. |

For reference, the above message is a reply to a message where: Here is some text from the lease: Lessee shall utilize the property for parking only with the exception of certain improvements heretofor made within the leased property including a sound wall extending onto the parking area, installation of dining booths used for food and beverage service, and construction of storage/restroom facilities, all for "Seacrets" nightclub which extend onto Lessors property, which said improvements have been constructed by Lessee and which said improvements are hereby acknowledged by Lessor. After reading the above I'm sorry I didn't use a stronger word than "debacle" to describe this deal. Remember how OPA played down the encroachment last year, mentioning only the sound wall? Apparently Seacrets, without OPA permission, not only built the sound wall on OPA property, but also dining booths and storarge/restroom facilities. OPA's strong response to the encroachment? A really tough negotiation that results in a new lease actually reducing Seacrets total costs. You can't make this stuff up. Seacrets has taken OPA to the cleaners..... again. |
