Seacrets gets the right of first refusal; total cost in first year of less than they were prepared to pay in prior lease; right to retrain their seating tables, bathrooms, storage, sound wall, etc., all built on OPA property without permission. Hi Joe, I haven't been reading this thread much .....as I got "MEGO" a LONG time ago. BUT...I don't see where "right of first refusal" is such a huge deal. What IS A BIG DEAL to me is .....did they give us more parking area to make up for the part they have taken without permission????? I am STILL really aggravated about what happened to me last July 4th at about 11:30 AM when the OP lot was full. I went over to Seacrets and their spaces were pretty much empty. The parking fellow would not allow me to park on one of their spaces. I asked him about the area where they had built on OP property. I wanted to park in front of the hill that they made. IT IS OURS. Everything back to the water is ours. He wouldn't let me do that and I didn't want to ruin my day by getting into some sort of bit hassle, so I left. ( I actually found a legal space at the new condo next door to OP! ) I want to be sure that we have gotten more space for what THEY TOOK from us without asking. Since you have the lease ...and I don't want to read all the stuff that has been written here.....could you please tell me that? At this point ...our fair share of parking is the only thing that really matters to the membership. I am just glad that the scare of the "99 Year Lease" is OVER. I am still trying to figure out how anyone thought that was a good deal for us. Thanks. Nancy |

For reference, the above message is a reply to a message where: More text from lease: Provided that the Lessee is in good standing under this Lease, the Lessee shall have a right of first refusal to purchase the real property described on Exhibit "A" attached hereto ("Property") on the same terms and conditions of any bona fide offer received by the Lessor. Seacrets gets the right of first refusal; total cost in first year of less than they were prepared to pay in prior lease; right to retrain their seating tables, bathrooms, storage, sound wall, etc., all built on OPA property without permission. For all these additional pluses for Seacrets, OPA receives $40,000 for the lease when our own consultant last August said $30,000 in old lease was under market value. Even in the last year of the five-year lease the total cost to Seacrets (lease and taxes) will be under $64,000, less than they were prepared to pay in the prior lease. This has to be one of the most one-sided negotiations in OPA history, and OPA has had some doozies. The papers say Bob Thompson negotiated this lease for OPA. Sad, very sad. Even sadder, the rest of the board signed on to this debacle. |
