Section 5: OPA Board Subject: OPA Loses IRS Case Msg# 823733

Joe: "The discussion about the firm and vote was all done at a public board meeting and is on video. It was reported here and in all local papers. I believe it was reported in an OPA newsletter" I can not remember or find any public disclosure that when PWC was hired Mr. Gomsak was a retired executive of that firm. You and I may have know it, but I guarantee you much of our membership didn't know it. For that matter I would bet you that there are sitting members of the board of directors who did not know it last week. "What is a travesty is strong innuendo of wrong doing" I think that "innuendo" is not at all what is happening. Let be try to be less subtle. I believe that there very well may be a conflict of interest anytime a board member recommends a firm when it appears that he may receives a benefit from said firm while exercising his fiduciary duty to our membership. Mr. Gomsak should have strongly disclosed his relationship with PWC and then recused himself from the vote to hire PWC. If you can not agree with that then please add your "head in the sand" icon once again. Marty |

For reference, the above message is a reply to a message where: I think this whole story should be made public beyond this forum. I sincerely doubt that there are many OPA members who are/were aware of this hiring of G's firm. I would also think the conflict of interest, if any should be investigated. This entire situation is a travesty. Marty makes an unsubstantiated comment and you are ready for a full investigation, even though you have no idea of what transpired, how it transpired, or why it transpired. The board voted to hire the firm in question as a consultant to the lead law firm, one out of Baltimore as I recall. The discussion about the firm and vote was all done at a public board meeting and is on video. It was reported here and in all local papers. I believe it was reported in an OPA newsletter. What is a travesty is strong innuendo of wrong doing with absolutely no knowledge of what actually transpired. |
