The inspector did not attempt to speak with the owner, she only sat in her car, called me, said there was nothing she could do due to the covers and then drove off.
But then again it was raining ! |

For reference, the above message is a reply to a message where: Did the inspector talk with the owner and seek permission to look at the vehicles? If so, did the owner refuse permission? If the inspector simply looked at the covered cars from the street and made no attempt to contact the owner for access, then I don't think the inspector was doing her job. If there are neighbors who will tell the inspector that the vehicles haven't been moved for seven years or more then this should provide adequate probable cause. You might request the inspector provide you with a complete written report on everything that was done or transpired between the inspector and the owner, and yourself. County law does indeed provide provision for the inspector to seek a court order if there is probable cause and the owner refuses access. County law is as follows: If the owner, operator or occupant refuses to allow such inspections, the code official shall, prior to any forcible entry and inspection, obtain a warrant for such inspection. The warrant shall be obtained by written application signed and sworn to by the code official setting forth the purpose of the inspection and the address and location of the premises to be inspected. When, upon such application, it shall appear to any Judge of the Circuit Court of Worcester County or to any Commissioners of the District Court for Worcester that there is probable cause to believe that there is a violation of any provision of this Title, then such Judge or Commissioners of the District Court may forthwith issue a warrant directed to the code official authorizing him to enter and inspect such premises. The warrant shall state that any inspection made thereunder shall be made within thirty days from the date of issuance thereof; and after the expiration of said thirty-day period, said warrant shall be void. |
