Now a lot of water has gone under the dam since I was on the board so the board members may see it like you do. IMO if the Board wants to continue it then it should be shown to the members as for what it is a "special assessment"on top of any additional assessment and the purpose for it.
John, has nothing to do with water under or over the dam. It simply has to do with the actual proposal made by Gomsak at the time. With minor hiccups the Gomsak proposal has been adopted by boards since then, as we saw the amount collected for the five-year plan raise over a five year period and then continued collection... albeit with debate. However, with regard to your comment about special assessments, yet again, I suggest you familiarize yourself with the OPA governing documents. I see no provision anywhere for a "special assessment," although I suspect a court would allow one if challenged. However, I do see the following in the Articles of Incorporation, and the language very clearly allows the board to set any assessment to include whatever amount the board believes is needed for "future needs.": 8. The Association shall have the power to levy an annual charge upon the members of the Association by: a. Fixing the amount of the annual charge each year, as determined by the Board of Directors, after consideration of the current maintenance needs, current needs, and future needs of the Association and is in accordance with the Declaration of Restrictions of the Sections of the Subdivision or any other document which established an annual charge within the Subdivision which is executed by the Association and recorded among the Land Records of Worcester County, Maryland; |

For reference, the above message is a reply to a message where: I'm not saying I agree with Gomsak's idea of collecting in advance, but his plan did indeed contemplate collecting $150 a year indefinitely after rising $30 a year for five years. Been thinking about this while listening to Prince and cutting some fresh herbs and fresh mozzeralla for tonights dinner of Braciole, with pasta over a red sauce along with saute spinach I agree it was Pete's idea however it was not past, as it appears to be now, to make it in perpetuity.
