I have not checked, but I presume that Tucker was appointed parliamentarian. Both he and the presiding officer are clearly responsible for knowing the bylaws provision for voting at the meeting.

For reference, the above message is a reply to a message where: Trying to separate a description of what Bailey has said from from a view of his abilities is just spin on your part. Not spin at all. Just proper use of the English language. I do not believe Bailey is a stupid man. However, even smart people can come up with stupid ideas. Are you sure about that? I was not at the meeting, but watched parts live and reviewed other parts on line. The one motion I saw appeared to be in accordance with 3.05 of the Bylaws. After some initial confusion regarding the manner of count, it appeared to me that the count was by voting cards raised in hands. My recollection was that there was not a final count because the limitation to voting cards clearly established the result. I am absolutely positive. I was at the meeting. When voting started they initially used voice. Then they went to hands. I suggested to Doug Parks that votes should be via card. Jeremy Tucker overruled and went with hand votes. Any cards you saw in the air appeared just briefly in the front rows right after I made my comment to Parks. After the meeting, I spoke with Tucker. He tried to explain to me how Roberts Rules (he had a copy) allow voice or raising of hands. I suggested to him that hands might well work with something like a board of directors where all the voters were known. I then asked him how he even knew the raised hands were those of association members, or how he knew if an individual owner owned more than one property, or if a husband/wife with one property were counted twice. I also explained to him that the cards are distributed, one per lot, to owners for the purpose of voting. He admitted he should have counted based on cards. The sky is falling tale is hysteria based on incomplete facts. Your comments qualify. Hysteria? If you see my comments about Bailey's stupid idea regarding owner responsibility as hysteria, it must not take much for you to see hysteria. There is no falling sky; there is no hysteria. What there is are comments regarding a stupid idea coming from the GM. Just because you do not agree does not turn those comments into hysteria. |
