Frank, you may not wish to discuss the issue of closed sessions and how they are abused by the board either. However, this is an important issue. As the board discussed the motion to go into closed session about any GM interference in the election of the OPA president (a perfectly acceptable topic for closed session), Steve Tuttle brought up another issue. Tuttle said there was more at play than the flap over any discussion between Rogers and Viola. Tuttle stated, "I will not discuss it in an open session but there is a second issue that is of concern to me that I would like us to talk about as a team. I think it effects how we move forward as a board." At that point every other board member, the GM and the attorney should have interrupted and told Tuttle that it would be a violation of the HOA Act unless he specified the actual topic an dhow discussiosn of the topic complied with the six or so reasons allowed by the Act for closed session. No one did so. Apparently the board went into closed session, discussed the Viola issue, then adjourned. After adjournment, according to the OPA news release, the board, as a entity with all seven members present, then decided to discuss the issue raised by Tuttle. This was a clear violation of the HOA act. |
