Jackie was very clear. The attorney found that the allegation of a hostile work environment was not substantiated and thus not illegal. I believe what Colby was actually alleging was a toxic work environment, which is not illegal per se but troublesome. Hostile work environment under Title Vii must be attached to a protected class such as her gender in order to state a claim, which I don’t think she was alleging. An employer can still act inappropriately and it is still legal. That’s exactly what Jackie said. The Board could still have taken some action even though the behavior was not illegal. Jackie is anything but radical. | ||||||

For reference, the above message is a reply to a message where: Legal? What are you talking about? This was an HR issue, not a criminal trial. You are making wild charges. You are sounding rather radical. |
