I have always believed the ECC didn’t have the authority or right to enter onto a private lot in Ocean Pines without the permission of the owner. My attorney believes the same and prevailed when push came to shove.
You could be correct. I would love to have a case reference to this 1986 episode. So, it is trespassing to remove an unauthorized sign, or go on a property to inspect a DR violation complaint, but not trespassing to have the board vote to go in and put a new roof on a home without the permission of the owner as is allowed by the DRs? |
