You need to get a legal opinion. There was no “case” reference in 1986 because the OPA admitted they were wrong, made Caliban whole and we in turn dropped all charges. I don’t know what Article 14 has to do with the subject at hand. Article 14 deals with maintenance and not signs. Speaking of Article 14, when was the last time the OPA used it? I can’t remember. Wasn’t there an issue about the OPA removing trash from a property and got into a pickle? “One man’s trash is another man’s treasure.” Marty |

For reference, the above message is a reply to a message where: I have always believed the ECC didn’t have the authority or right to enter onto a private lot in Ocean Pines without the permission of the owner. My attorney believes the same and prevailed when push came to shove. You could be correct. I would love to have a case reference to this 1986 episode. So, it is trespassing to remove an unauthorized sign, or go on a property to inspect a DR violation complaint, but not trespassing to have the board vote to go in and put a new roof on a home without the permission of the owner as is allowed by the DRs? |
