That's the "hammer clause".
A good letter. I always hold my enthusiasm when reading my lawyers' side of the legal argument until I read the answer to the complaint....but it's hard to see what their "compelling' answer might be. I also think that there should be a demand for a full accounting of how the Sanitary Commission got to this point. It's a credible threat but, in any case, I'm not sure that it should even be a negotiating tactic. No matter the effect on "employee morale", how do we insure that it doesn't happen again? Damn the typos!! Full speed ahead!! |

For reference, the above message is a reply to a message where: A key paragraph: If a majority of the Commissioners proceed with their unlawful and unfair plan, and take further deliberate steps in that direction, OPA and other ratepayers would likely initiate civil litigation, and advance claims against the County and certain Commissioners, including breach of fiduciary duty, equal protection violation under the Fourteenth Amendment of the U.S. Constitution, for declaratory and injunctive relief, for monetary damages and attorney’s fees, for violation of applicable State and County Code provisions, for administrative mandamus, and/or for unlawful taking. |
