Joe, PLEASE! ENOUGH! The new lease was reorganized and updated. Therefore wording changed and some clauses were added. Both the 1999 and 2008 leases reference the same May 17, 1982 Deed which the new lease refers to as well. The deed encompasses the entire property. The 1999 and 2008 both say ".... more particularly described in a certain Deed dated May 17, 1982...". It is clear that the leases are for the same property as described in the same deed. Ted

For reference, the above message is a reply to a message where: Marty, if you can show me in the November 1, 2008 lease the WORDS "all that certain property," I'll buy you dinner. The words Marty, the words. If the new lease contains those words it is a change in the wording of the prior lease. Given some are contending the old lease unequivocally covered Seacrets parking use of the entire property (even wetlands) why would it have been necessary to add the changed wording in the new lease? And why are you still discussing this? |
