Actually, It was the ARC that initiated the concept of freezing amenities and voting rights. It was then presented to the BOD by the ARC Liaison, Dr. Horn. The concept was based partly upon Maryland HB 615, adopted into law on October 1, 2022. There was hope that loss of amenities and voting rights suspension (currently the only controls available) may persuade violators to correct violations more expediently.
While only some of the OP sections have DR's that allow for fines, OP has not utilized this option. It would require BOD action and needs to be immediately addressed and implemented. In theory, it should assist with enforcement and bring closure to many of these open matters quickly. It would also eliminate the need for legal posturing, court scheduling and subsequent expense to the HOA. In terms of amenity entry, North Star, the software used by OPA supposedly has the ability to flag entries on memberships and by address. So in concept, entry should be denied for a violator (or violators address) that has had amenity privileges suspended. Voting privileges are also suspended as they would be for other reasons such as unpaid dues or outstanding fees. Also, the Park not only has it's own governing/HOA, but it also has the ability to fine for violations. This is true in many of the newer sections and subsequently why many are less of an eyesore and as previously mentioned not overwhelming the list of violations. There are many reasons why the community is in this quandary and the powers to be need to work with all stakeholders involved to change the current trajectory. Have faith though, dedicated people at all levels, are onboard and committed to do the work of bringing change. We just need to agree to all speak from a cooperative and productive voice regarding the problems and solutions. Because division on these issues will not produce beneficial and desired results. |

For reference, the above message is a reply to a message where: It was Director Colette Horn who suggested removing the right to vote or use amenities would influence owners to fix violations. Residents with DR violations might be prohibited from purchasing amenity memberships but not paying a daily fee to use our fee-based amenities. Whether you are checking in at the golf course, any of our pools or the racquet complex, no one at those desks would know if you are on the DR list. |
