I did read it. I get the part about threatening legal action against the County as an entity. What I don't understand is what is meant to threaten to advance claims against certain Commissioners. It sounds like a threat to take civil action, e.g. lawsuit with monetary damages, against individual Commissioners should they vote to take formal action that punishes OPA rate payers. | ||||||

For reference, the above message is a reply to a message where: What exactly are the claims against certain Commissioners? And which Commissioners? Read what Bright wrote: "and advance claims against the County and certain Commissioners, including breach of fiduciary duty, equal protection violation under the Fourteenth Amendment of the U.S. Constitution, for declaratory and injunctive relief, for monetary damages and attorney’s fees, for violation of applicable State and County Code provisions, for administrative mandamus, and/or for unlawful taking." As for which commissioners, one might assume any who vote to move forward with the "including" referenced above. Keep in mind, the Commissioners have yet to take any formal action. Depends on what they vote to do when the sewer/water budgets are set in a couple of months. I assume the “threat” is based on some legal provision that the commissioners, while elected, cannot knowingly make laws or take actions that violate laws they are incapable of changing. |
